Terms and Conditions

Payment

1. A non-refundable booking fee of 50% of your total order value is required to confirm any order with JoJo’s Treat House. The booking fee covers admin and design duties associated with the inquiry and booking, as well as preparation of your order. The booking fee/save-the-date payment is non-refundable and non-transferrable and secures a position in our diary which closes this spot off to other bookings. Orders made within two weeks (2) of your event require full payment to secure your booking.

2. Full payment for the order is to be made two weeks (2) weeks before delivery or collection of your order. Failure to do so will result in your order being cancelled, with any monies over and above your 50% deposit being refunded to you. Items will not be released unless full payment has been received.

3. Payment due dates are confirmed with finalization of your order, and it is the client's responsibility to honour those dates.

Postponements/Cancellations

4. Public Health and Safety lockdowns are a risk and a responsibility that you take on when booking your order. We ask that you fully consider this and our postponement/cancellation policy when booking your event with JoJo’s Treat House as we cannot be held financially responsible in the event of a lockdown. A PH&S lockdown will not entitle you to a refund or override our booking terms and conditions which you agree to when paying a booking fee.

 

5. We are unable to accept postponements/cancellations of orders within one week (1) of your event. In some, but not all cases, it may be possible for us to offer a partial credit for a future purchase to use within twelve months (12) on a mutually agreed date. The amount of credit will depend on how much work has already been done on your order and excludes the 50% non-refundable booking fee/save-the-date payment. With more than one week's (1) notice, if you need to postpone/cancel your event, please get in contact with us as soon as possible to discuss your options. These will be assessed on a case-by-case basis and in most instances, it may be possible for us to offer a credit for a future purchase to use within twelve months (12) on a mutually agreed date. In the instance of a PH&S lockdown, any future credit will be determined by how much work we have completed on your order, and we will pull out all the stops to get your cake to you early if required. We retain the right to cancel the booking ourselves in very unusual circumstances beyond our control, such as ill health/family emergency/isolation, during which we will refund any money taken in full and attempt organize another local cake decorator to provide a replacement.

 

6. Public Health and Safety rules and regulations are different for every venue and constantly changing. We request that you keep up to date with the current regulations surrounding food (cake/desserts) etc. and any venue restrictions and requirements and let us know of any changes as soon as possible. JoJo’s Treat House is not liable for any rules or regulations that are broken at your event where our food is served or displayed.

 

7. If JoJo’s Treat House is unable to fulfill your order for reasons including but not limited to illness, accident, or injury, JoJo’s Treat House reserves the right to cancel the order and will refund all monies paid by you (relative to the cancelled order), with no further compensation payable.

 

8. Quotes are valid for 7 days and prices are subject to change without notice. All prices are in the Australian Dollar.

 

Order Details

 

9. All major details must be finalized no less than two (2) weeks prior to the requested delivery date. (i.e colours, flowers, flavours, fonts etc). Any alterations requested after the initial quote, may result in the initial cake quote being invalid. You will be notified of this change by JoJo’s Treat House.

 

10. All dietary requirements must be disclosed upon ordering. JoJo’s Treat House takes no responsibility for any medical conditions due to consumption of JoJo’s Treat House products. Whilst we offer dietary/allergy friendly options, we are not a gluten/dairy/nut/egg/lactose/soy/wheat free kitchen and due to the nature of our business, cannot guarantee that any item is 100% allergen free. All precautions are taken, however cross contamination can occur. These products are ordered/consumed at your own risk, and we cannot be held responsible.

 

11. Where toppers/decorations are provided on cakes (plastic flowers, acrylic toppers, toys, handmade fondant items, fresh or faux flowers) they are strictly provided as decoration only and are not to be consumed. They may contain wire/toothpicks/polystyrene which can be dangerous.

 

12. Flowers supplied by JoJo’s Treat House are subject to availability. If your chosen flowers/colours are not available, then we will endeavour to match them as closely as possible to those requested. We cannot be held responsible if the specific flowers/colour are not available to us on the day.

 

13. JoJo’s Treat House retains the right to photograph and share progress and finished images/videos on social media and our website. We will not share images/videos of the complete final design until after your event has commenced so we don't ruin the surprise.

 

Cake Care after Handover

 

14. For deliveries, the nominated person receiving the item will be required to inspect the product and sign a delivery and acceptance form before the item will be released. Cutting and structure details will be provided to your venue if required.

 

15. For pick up, once your order has been collected, all responsibility is transferred to the customer. We make every effort to ensure cakes are structured safely for travel and we are not liable for any loss or damage caused after collection. This includes improper storage, handling, or transport.

 

16. JoJo’s Treat House takes no responsibility for items, including fresh flowers, that are placed on our cakes by a third party after delivery/pick up. Without the appropriate food and safety certifications, third party items have the potential to reduce the serving count and/or render the cake inedible if proper handling procedures are not followed. The cake will no longer be covered by the insurance policy held by JoJo’s Treat House and the client accepts all responsibility for the cake if this occurs.

 

17. Buttercream and semi-naked cakes should be refrigerated and brought to room temperature (1-2hrs) prior to serving. Cakes and cupcakes with fondant elements should NEVER be refrigerated, but instead stored in a cool, dry, dark spot. We cannot be held responsible if your venue does not have appropriate refrigeration or air conditioning to keep your cake/desserts cool and stable but will work with them to organise a later delivery where possible.

 

Refunds

 

18. JoJo’s Treat House cannot be held responsible if you simply change your mind or don't like the design. If you give minimal instructions during ordering, we will create a design for you based on supplied inspiration imagery and while every effort is made to meet customer expectations, please be aware that in cases where images of cakes/desserts are supplied, that the outcome may vary from the images - either through our creative process or availability of products. Not liking a design will not be considered a valid reason for a return/refund. We do not copy other designers work under any circumstances and we retain the right to problem solve and make minor design changes that may affect the decoration, proportion/structure or flower placement if we determine its required for reasons including but not limited to stability, aesthetics, supply issues etc. Where possible, we will consult with you first on any changes required. Exact colours can be difficult to achieve with food colourings so we cannot guarantee an exact match however we will try our best when requested. If your items are part of a corporate campaign/branding suite, please supply all relevant style guidelines, high resolution files, collateral, or colour swatches to ensure the finished product matches.

 

19. In the unlikely circumstance that you may need to return a product, due to the perishable nature, if a complaint is not filed immediately and the product returned in full the same day or the next day at the latest, the item will not be considered for refund. Returning a fraction of the product (ie. 10 slices of a 20 serve cake) will not be considered a return and cannot be considered for a refund. A refund or partial refund may be offered at the discretion of JoJo’s Treat House once we have assessed the returned product in full. Cakes picked up earlier than day of consumption will not be considered for refund, no matter the problem. There are too many storage variables that we cannot be held responsible for. We cannot offer a refund if you damage or drop a cake after pick up/delivery, if you purchase a cake larger than you need or choose a flavour that you don't like.

 

20. A minimum refundable security bond of $100 will apply for all hire items. If an item is not returned, or is broken, damaged or returned with parts missing, payment of the full replacement value of each item is required. The security bond will be refunded once payment is cleared or can be used towards your replacement payment. The hire fee quoted is for a hire period of 3 days. You must organize pickup and drop off times with JoJo’s Treat House. We do not include delivery/collection of hire equipment unless specified. This service incurs an additional charge.

 

General

 

21. By placing an order with JoJo’s Treat House and paying your 50% booking fee, you are agreeing to the above terms and conditions.

 

22. Terms and conditions are subject to change and the current iteration will be on the bottom of your invoice. If you have any questions, please contact us prior to placing your order.

Additionally, we may also collect any other information you provide while interacting with us.

We do not hold any financial information that belongs to you; however, you should be aware that you may be providing financial information to a third party billing service to whom you may be directed at the time of agreeing to a service or purchasing a product on our website. Please ensure that you have thoroughly read their terms and conditions prior to the use of their services, as information provided to a third party is subject to their terms and conditions and not these.

We collect personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website and when we engage in business activities with you. We cannot guarantee the security of any information that you transmit to us or receive from us.  Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this privacy policy.

You may request details of personal information that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth), and to the extent applicable to the EU GDPR. We reserve the right to refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act or any other applicable law.
